What does a PJC actually do to your NC insurance?
A prayer for judgment continued, if granted, keeps the statutory insurance surcharge off you completely — but only once per household every five years. Separately, the DMV ignores your first two PJCs every five years for licence points. Two limits, two clocks. Spend it on the ticket carrying the biggest surcharge.
Two systems, two clocks
Insurance and the DMV count PJCs on different schedules, and the insurance one is the expensive one.
| System | How many are free | Window | The next one |
|---|---|---|---|
| Insurance (SDIP)NCRB A-25-4 | How many are freeOne per household — everyone on the policy shares it | Window5 yr | The next oneRated as an ordinary conviction: full SDIP points, full surcharge |
| Licence points (DMV)G.S. 20-4.01(4a) | How many are freeFirst 2 per driver — not shared | Window5 yr | The next oneA third or later PJC counts as a conviction for licence points |
CDL holders sit outside both benefits: every PJC counts against a commercial licence. The insurance window is 5 years where the earlier household PJC was granted on or after July 1, 2025, and 3 years where it was granted before that date.
The charges that cannot take one
- Speeding more than 25 mph over the limit — barred. G.S. 20-141(p)
- Passing a stopped school bus — barred. G.S. 20-217(e)
- Driving while impaired (DWI) — barred. G.S. 20-179 case law
- Any CDL holder — every PJC counts against a commercial licence, so there is no forgiveness to spend. G.S. 20-4.01(4a)
Do we have one to spend?
Three questions. Nothing is sent anywhere.
Answer all three and the answer appears here.
Burn it or bank it?
Because insurance forgives one per household per five years, a PJC is an asset with a price tag. Its value on a given ticket is exactly the surcharge it keeps off you — no more. On a 20-over ticket at the example premium below, that is $1,650 over 3 years, if granted.
| Situation | The call | Why |
|---|---|---|
| Big surcharge, no cheaper reduction on the table | Burn it | The dollars it keeps off you now are the most it will ever be worth, if granted. |
| Ten-and-under speeding with an otherwise clean window | Bank it | No surcharge attaches anyway, so a PJC would buy you nothing here. |
| A reduction costs less than the surcharge you would avoid | Bank it | Buy the reduction and keep the household's PJC for a worse ticket. |
| A newly licensed driver in the house with years of exposure ahead | Think twice | One household PJC every 5 years — spending it now leaves them nothing. |
Take the date of any earlier household PJC and add the window: that is the day the forgiveness comes back.
Statutory example: a $1,000/yr base premium. The surcharge is a percentage of your own base premium, so put your number in the calculator to see your dollars. NCRB A-25-4
The judge decides, and nobody else
A prayer for judgment continued is a request made to the court — not a right, and not a form you can file yourself. Whether it is granted is discretionary, and practice differs between counties, sessions, and individual judges. We can tell you what a PJC is worth in dollars if granted; we cannot tell you whether it will be, and nobody honestly can. Price the outcome where it is refused first, and treat the grant as upside.
If your licence is from another state
If your license is from another state, assume a PJC may be treated there as a plain conviction — we cannot verify how any other state records it. Your home state is widely said to treat a PJC as a plain conviction and to rate it that way, but we have found no primary source for it — treat that as a warning rather than a fact. Check with your own licensing authority before you rely on a PJC to protect an out-of-state record. NCRB A-25-4
PJC questions people actually ask
- How often can you get a PJC in North Carolina?
- Two limits run at once. Insurance forgives one PJC per household every five years, so a spouse's or teenager's PJC uses up yours. The DMV separately ignores the first two PJCs per driver every five years for licence points; a third inside five years counts as a conviction for points.
- Does a PJC keep your insurance rate from going up?
- If granted, yes — a PJC carries no SDIP points and no surcharge, provided nobody in the household used one inside the lookback window. That window is five years where the earlier PJC was granted on or after July 1, 2025, and three years where it was granted before that date.
- Which North Carolina charges cannot get a PJC?
- Speeding more than 25 mph over the limit, passing a stopped school bus, and driving while impaired are barred. CDL holders gain nothing either, because every PJC counts against a commercial licence. On other charges a PJC may be requested, and granting it is the judge's decision alone.
- Is a PJC a conviction?
- A PJC is a guilty finding where the judge continues sentencing, so no judgment enters. North Carolina treats it as neither a clean record nor a full conviction, inside the limits above. Other states are generally said to record it as a plain conviction, though no primary source confirms that.
- Can anyone promise you a PJC?
- No. A prayer for judgment continued is a request, and granting one sits entirely within the judge's discretion. Practice varies between counties, sessions, and individual judges. Price the outcome where it is refused, then treat a grant as upside rather than as the plan you are counting on.
Opens the calculator on a 20-over ticket — change it to yours in one tap. Add your premium and the PJC value comes back in dollars instead of percentages.
